    at one time, somewhere in this web site, I mentioned to someone that the actors (and for other entertainers too) should form an organization wherein it can establish itself to protect its members against predatory agents/producers/directors, etc. and whoever takes advantage of this seemingly vulnerable group of people who have to survive and be happy like anybody else. maybe such kind of a group already exists in south korea for a specific profession, like for doctors, or lawyers, or labor group, etc. so, there should be one patterned similarly for actors (or specific form of entertainers) where the members pay a membership fee and get benefits, including legal advice, consultation, and representation, maybe could formulate a standard contract with agents, etc., financial advice and consultation, medical assistance, etc. etc. from what i learned in this thread, it is sad that in a highly developed country like south korea where democracy exists, there is not fair treatment to everybody (sadly true too in other established democracies), specifically the actors and entertainers who contribute a whole lot to their economy (a fact confirmed by Korean news the other day). there is strength in numbers, “united we stand,…”, someone or some people should start what needs to be done for the greater good. as for PSH, true that he blundered, but i think is a victim of manipulated circumstances. i wish him well.

    What has happened with PSH is very,very sad. The manner in which he was treated by media, by the police and citizens of his own country left a sad and negative image about S.Koreea. I hope his case will reveal all the dirt of South Korean’s entertainment industry and the human rights of SK celebrities will be respected. I hope PSH is doing alright now and he will be fine. I wish him, from my heart, all the best in life and career. I pray for him and his family.

    The Prosecutor’s Office has taken over the case. It is all anyone can do to wait for their decision.
    This is the way it ought to be, with the P’s Office, and with the police. When it was under the WPS, it wasn’t supposed to leak information to the press. If they didn’t, then PSH’s lawyers, didn’t have to do so either. The police is supposed to say: “The case is under investigation. We can’t comment on it.”

    Both of you are right. It’s an open secret that those agencies exploit their contractual artists. Those rookies are under unfair treaties, some artists committed suicide under pressure or sexual assault, and some (or may be most) of the celebrities go through a hard time to resolve their contract either by money or lawsuit, like Micky.
    PSH is a rising star; he is the #1 star in his former company. In his former mc’s eyes, he is a goose who laid golden eggs. PSH refused to resign would strike off most of its revenue. A lesson to PSH was a “normal action” in their field. But, by playing such cunning stratagem was insane and uncivilized. Those SK entertainment celebrities should stand up, use their power & effectiveness to form a union like other professions to protect their rights. When PSH is in the midst of the mess, his “chingu” such as Lee Byung Hun, should take this opportunity to fight for their right. Don’t they know “unity makes strength”?

    Commentaries in the report explain why police is ineffective in SK.
    It also explains the ineffective and illegal behavior of WPS in investigating and dealing with PSH’s case.
    What is surprising is that many SK dramas & movies depict of police as ineffective and corrupted is indeed a true reflection of real life.

    Extracts from the report:

    “April 2012 has been a devastating month for the public image of the Korean National Police Agency (KNPA). Public ire was further stoked with the revelation that the police in Suwon had attempted to cover up the extent of their incompetence with “brazen lies,” as described by KNPA commissioner general Cho Hyun-oh.

    Criticism of police performance has come also from the very top. President Lee Myung-bak called for drastic police reform in the wake of the Suwon murder (bungled police response to an emergency call from a kidnap victim who was later murdered) and revelations that officers in Seoul took bribes from room salon operators to turn a blind eye to prostitution.
    These and other knocks to the reputation of the force have raised fundamental questions about the performance of the KNPA generally.”

    In summary, the police are ineffective due to the following reasons:

    * Mass hiring of 10,000 to 20,000 unqualified police officers for 1988 Seoul Olympics – many of whom are in the higher ranks of the force today

    * Ineffective recruitment process – passing written exam is the most important criteria in hiring process – instead of physical ability and vocational aptitude which are more important criteria to become successful policemen. This is especially so for nowadays, as police officers are required to perform a variety of daily tasks from helping citizens to fighting criminals.

    Lee Yoon-ho (“Lee”), a Professor of Police Administration at Dongguk University, reinforced this view – ” You are commissioned first and then get education and training. You don’t need to have the police brain, you don’t need to have the police heart ― passion, you don’t need that. All that you need is to pass the exam.”

    * Inadequate training period of only 8 months – relatively short by international comparisons.
    * Lack of appropriate education and training leading to lack of experience as crime investigators.

    * Police behaved irresponsibly – as they are not able to respond to emergencies and are not meticulous in their investigations as detailed examinations are not performed. Police also do not research further on the information provided. If there are not many clues, police officers often give up without solving the problem or cover up the problem.

    * Poor public image of police is a further impediment to effective policing.
    Public distrust of police stems from abuse of police power and authority (e.g. some years ago, police arrested and detained many civilians who participated in the peaceful candlelight vigils to protest against beef import deal with US).

    * Lack of promotional opportunities for the average officer within the force.
    Lower-ranked officers struggle to rise through the ranks as most of the higher positions are filled with fresh graduates of the Korean National Police University (KNPU) in Yongin. KNPU produces about 120 graduates each year who start out at the lieutenant level.
    Rank-and-file officers instead must pass a written test, physical and an interview.
    Police force are also plagued by seniority.

    * 2 pronged stereotype police force emerging in SK – INEFFICIENT AND CORRUPT. Corrupted police officers have thus compromised efficiency of police force.

    * Concerns on police political independence as political considerations usually comes first when the Korea police office decides on situations because the Korean police system is a centralized, national system. High-ranking police officers are quite sensitive and they try to attune to the opinions of big-power politicians.

    * Seemingly no clear implementations of police reforms called for by ex-President Lee Myung-bak.

    Korea’s law agencies ranked most corrupt

    SOUTH KOREA – Prosecutors, police and judges scored the lowest points among state organizations in the transparency index compiled by the Anti-Corruption and Civil Rights Commission.

    The survey, which evaluated 627 government organizations, showed that the Ministry of Justice received the lowest grade on the 5-level grading scale among the central administrative agencies.

    About 244,000 participants including citizens, public officers, reporters and civil activists were surveyed for the report.

    Administrative agencies that received the 4th grade, which is the 2nd lowest, include the Korean Intellectual Property Office, Ministry of National Defence, and the Ministry of Foreign Affairs and Trade.

    The Ministry of Gender Equality and Family and the Ministry of Government Legislation obtained the top grade.

    None of the 16 city and provincial governments, excluding that of Sejong City, received the highest transparency grade.

    The Seoul and Busan City governments were given the 4th, while Jeju Province received the 5th grade, the lowest.

    Law enforcement and regulatory agencies did not fair better with the National Tax Service, National Police Agency, and the Supreme Prosecutors’ Office gaining the lowest grade.

    The average for public agencies was the 3rd grade.

    “Those agencies which have been marked with low integrity levels will be asked to prepare a plan to improve their integrity levels, and will be monitored to see whether they stick to the plan,” the Anti-Corruption and Civil Rights Commission said in a statement.

    The 2 law enforcement agencies have recently been tangled up in sex and bribery scandals.

    Recently surfaced scandals involving prosecutors include the case of a high ranking prosecutor taking over 900 million won (S$1.02 million) from notorious conman Cho Hee-pal and several other conglomerates.

    The case, which triggered conflict over investigative power between the two law enforcement agencies, was followed by the case of a 30-year-old prosecutor having sexual relations with a suspect.

    The investigation into the latter case led to the prosecutor being indicted on charges of bribery, a decision which has incited criticism in and out of the prosecutors’ office about its legitimacy.

    “I deeply apologized for the concerns and disappointment to the public,” Prosecutor-General Han Sang-dae said last week, promising the reform of the prosecution.

    Meanwhile, a 50-year-old police officer was charged with having sex for over 2 years with a teenager who had run away from home.

    “The National Assembly’s Legislation and Judiciary Committee confirmed yesterday Park’s decision to name Chae Dong-wook, head of the Seoul High Prosecutors’ Office, as the new prosecutor general. The 54-year-old veteran prosecutor received rare bipartisan backing after the committee questioned him at a hearing Tuesday.

    Ruling and opposition parties said they concurred that Chae has rich experience in investigations and a strong will to reform the prosecution. He was also praised for good ethics.

    A native of Seoul, Chae is a graduate of Seoul National University who passed the bar exam in 1982. Throughout his career, Chae investigated many high-profile cases involving political bigwigs.     Extracts of report – Overview of the Investigation Organizations:

    “Criminal investigation organizations of Korea are divided into 2 categories:
    One is prosecutors and the other is judicial police officers.
    The public prosecutor has authority to investigate criminal cases and is entrusted to exclusive
    authority, albeit with a minor exception, to initiate criminal procedures by indicting the offenders.

    The judicial police officer also has authority to conduct investigations under the supervision of the public prosecutor.

    Judicial police officers are made up of general judicial police officers that deal with criminal cases in general and special judicial police officers
    that handle the specific type of cases set out in the relevant laws.

    When a crime occurs, the judicial police officer usually initiates the investigation. In reality, a police officer investigates daily crimes such as thefts, violence or traffic related crimes. Upon conclusion, the case is then transferred to the public prosecutor’s office where a public prosecutor continues with the investigation by questioning the suspect and related persons, examining documents and other evidence. The public prosecutor may conduct additional
    investigations as necessary. Due to such investigations by the public prosecutor, those who need not be punished will be released from the process at an early stage. Consequently, the conviction rate at trial is rather high, constantly more than 90 percent.
    In the case of complex offenses and white-collar crimes, such as large-scale bribery cases involving politicians or high ranking public officials, economic offenses, narcotics offenses, environmental offenses, organized crimes, tax
    evasions and police misconduct, the public prosecutor can initiate the investigation ex officio or without prior investigation by the judicial police officer.

    Public Prosecutor’s Offices are under the jurisdiction of the Ministry of Justice.
    They consist of the
    1) Supreme Public Prosecutor’s Office;
    2) the High Public Prosecutor’s Office;
    3) the District Public Prosecutor’s Office and their respective Branch Offices, each corresponding to the court within their jurisdiction.

    Police officers belong to the National Police
    Agency and are referred to as ‘judicial police officers’ in the Criminal Procedure Act.
    The Korean police have almost the same functions and duties as those of other countries.

    And there is a National Intelligence Service, which investigates national security crimes such as espionage, insurrection, inducement of foreign aggression, rebellion and violation of the
    National Security Act.
    It also performs analysis and collection of intelligence concerning national security.

    And there are special investigative agencies which are described as ‘special judicial police officers’ in the Criminal Procedure Act.
    In the case of special offences such as the customs offence of tax evasion, special investigative agencies, such as the
    Customs Office, the Tax Administration Agency conduct the investigations.

    Relationship between Prosecutor and Judicial Police Officer:

    Under the Korean Criminal Procedure Law, the relationship between the prosecutor and the judicial police officer is not one of cooperation, but one of order-obedience.

    Accordingly, the prosecutor directs and supervises the judicial police officers in connection with criminal investigation and the police should obey the prosecutor’s official order.

    These duties of the prosecutor are essential in realizing the spirit of the rule of law which requires the protection of human rights and due process in the investigation of crimes.

    Judicial police officers should obey any official order issued by the prosecutors.
    Moreover, the judicial police officers, as assistants of the prosecutors, can investigate crimes only under the control of prosecutors.

    In case a judicial police officer does not comply with a prosecutor’s order or commits any unjust act in connection with performing his/
    her duty, that prosecutor can, through his/her chief prosecutor, request the officer to stop the investigation or request his/her superior officer to replace him/her.

    If necessary, prosecutors can request the police or other executive departments to dispatch some of their officers to the prosecutor’s office.”

    #lisa6: thanks for your extensive research and info provided regarding justice system in korea. at this point i hope that the prosecutors handling psh case will thoroughly review or conduct a new investigation to show light in favor of psh. for all his supporting fans, i wish psh would send word that he is okay, despite what is going on, so we would feel at little at rest about his health specially.
